The federal restriction that took effect on January 1, 2025 is on manufacturing, importing, selling and distributing certain new equipment and on installing new systems above a refrigerant global warming potential limit. EPA deliberately classified condensing units and other components as specified components so that they were not caught by those restrictions, in its own words to allow for the continued servicing and maintenance of existing equipment. Nothing in it reaches a system already bolted to a pad in your yard. The Village of Liverpool states that it uses the most recent edition of the New York State Uniform Code and that a building permit is required for any work which must conform to the Uniform Code, the Energy Code and the Village Zoning Ordinance. Its published list of such work names installation of any gas lines or appliance including space heaters, and installation of any new or replacement furnace, central air conditioning, boiler, gas fireplace or other heating equipment. The village publishes a separate HVAC Permit Application, Mechanical Permit Application and Heating Appliance and Chimney Application. It states that no person shall commence any work for which a building permit is required without first having obtained one from the Code Official.

The American Community Survey 2020-2024 five-year estimates report the median year structure built in Liverpool village as 1939 or earlier. The Agency states that the final rule classified condensing units as one of five specified components at 40 CFR 84.52 to make clear that they were not subject to the restrictions on manufacture, import, sale, distribution, or export and thus allow for the continued servicing and maintenance of existing equipment.
